The terms 'Sulekha' and 'Sulekha.com' are used in this document (or Agreement) to refer to the Web site itself and to Sulekha.com, the company which owns and operates the Sulekha website.

Sulekha.com, or Sulekha, is an online networking community that connects its members through networks of friends and through a variety of services that it provides to its members. This document covers the terms and conditions under which these services are provided and the privacy policy of the site.

Sulekha is entitled to assign this agreement, and all rights and obligations hereunder, to a successor to all or any of its assets, whether by sale, merger or otherwise. These terms shall be binding upon and shall inure to the benefit of the parties hereto and their respective representatives, heirs, administrators, successors and permitted assigns except as otherwise provided herein.

Sulekha provides a platform for interaction and transaction between Users and Vendors. Sulekha is not a party to any transactions between the Vendor/s and the Users.

The voucher that you purchase is redeemable for products or services by the seller of such products and services, or the Service Provider. The Service Provider, not Sulekha, is the seller of the products and services and is solely responsible for redeeming any voucher you purchase.

The Voucher shall have the necessary redemption instructions on it. The Vouchers may have an offer period, or expiry date, mentioned on it. You shall use it accordingly.

Unless otherwise stated, you will not be entitled to receive credit or cash-back for whatever value of the Voucher you don't use.

Unless otherwise stated, you cannot combine the Voucher offer with other special offers or promotions that may be on.

Unless there is something wrong with the purchase or an error attributable to us, we do not offer refunds. Vouchers once sold are non-refundable, whether you use it or not.

Neither Sulekha nor the Service Provider shall have any liability in the event you lose your Voucher at the Service Provider venue.

All commercial / contractual terms (including, without limitation, price, shipping costs, payment methods, payment terms, date, period and mode of delivery, warranties and after sales services),are offered by and agreed to between the Vendors and the Users.Sulekha does not control or advice or determine or otherwise involved in the offering or acceptance of such commercial / contractual terms.

Sulekha is not responsible for any non-performance or breach of any contract entered into between Users and Vendors. Sulekha does not guarantee that the concerned Vendor/s will perform any transaction concluded on the Website. Sulekha shall not be required to mediate or resolve any dispute or disagreement between the Vendors and the Users.

Sulekha does not make any representation or Warranty as to the attributes (such as quality, worth, marketability, etc.) of the goods and services proposed to be sold or offered to be sold or purchased on the Website. In particular, Sulekha does not implicitly or explicitly support or endorse the sale or purchase of any goods or services on the Website. Sulekha accepts no liability for any errors or omissions, whether on behalf of itself or third parties.

Sulekha does not make any representation or warranty as to the attributes (such as legal title, creditworthiness, identity, etc.) of any of theVendors. Users are advised to independently verify the bona fides of any particular Vendor that they may choose to deal with on the Website and use their best judgment.

Sulekha does not at any point of time during any transaction between the Vendor and User come into or take possession of any of the goods or services offered by Vendors/s, nordoes it at any point gain title to or have any rights or claims over the goods or services offered by the Vendor to the User.

The Website is only a venue through which Users can reach a larger base to buy goods and services. Sulekha is only providing a platform for communication and it is agreed that the contract for sale of any of the products or services shall be a strictly bipartite contract between the Vendors/s and the Users. At no time shall any right, title or interest over the goods vest with Sulekha nor shall Sulekha have any obligations or liabilities in respect of such contract. Sulekha is not responsible for unsatisfactory or delayed performance of services or damages or delays as a result of items which are out of stock, back ordered or otherwise unavailable. All items are offered only for a restricted time and only for the available supply.

The Users release and indemnify Sulekha and/or any of its officers and representatives from any cost, damage, liability or other consequence of any of the actions of the Users of the Website and specifically waive any claims that they may have in this behalf under any applicable law. Sulekha does not control the information provided by Vendors which is made available on the Website and takes nor responsibility for such information.

All orders shall be pre-approved with an acceptable method of payment as established by Sulekha which may call for and require additional verification or information.
The address at which delivery of the product ordered by the User are to be made should be correct and proper in all respects. After the receipt of payment from the User, the Vendor shall arrange for the invoicing and delivery of the product to the buyer at the shipping address provided by the Buyer. Any and all orders placed by the User on this Site are a firm commitment to purchase and the User is obligated to complete the transaction and not contest it in anyway. Before placing an order the User is advised to check the product description carefully. By placing an order for a product, the User agrees to be bound by the conditions of sale included in the item's description.
We as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the preset limit mutually agreed by us with our acquiring bank from time to time.

The State government levies the octroi chagrges when the product enters the state. These charges are applicable in the State of Maharashtra and the charges fluctuate as per the Government regulations and we are unable to confirm the amount. The octroi charges vary from 3% to 6% of the product value. This also vary from State to State.

The octroi charge is payable by the recipient at the time of delivery. The courier will collect the octroi amount from the recipient at the time of delivery. Any product for delivery in a location that falls under the octroi zone will attract applicable government duties, which are the octroi charges. After paying Octroi charges send us a scanned copy of the receipt and we will reimburse you with a gift voucher for the same amount.

Sulekha is a service provider as defined in the Digital Millennium Copyright Act of 1998. Sulekha is an interactive computer service as defined by 47 U.S.C.230. We do not control the truth or accuracy of content posted or the safety, or legality of the items advertised or sold. Sulekha does not spam or sell/lease its user information to third parties.

This Privacy Policy covers Sulekha's treatment of personally identifiable information that Sulekha collects when you are on the Sulekha site, and when you use Sulekha's services. This policy also covers Sulekha's treatment of any personally identifiable information that Sulekha's business partners share with Sulekha. You will also have the option to upload your contact information either manually or via a computer upload directly from your Hotmail, Yahoo or Outlook section into your own private address book on Sulekha. All information entered there will only be viewable by you and will not be searchable by others in the Sulekha network without your permission. All information that you enter or upload about your contacts will be covered by the same terms of this privacy policy as cover your own personally identifiable information.

RECOGNIZING YOU AS A SULEKHA MEMBER: For Sulekha to recognize you as a registered member, you must login with your login email and password. At the time of login, you will have the option to instruct the site to remember you so when you come back the next time to use Sulekha, you would not have to login with your email and password. As is common in the industry, Sulekha uses the technology of cookies and site log files to monitor user registration, to recognize registered members when they revisit the site and to track site usage. Sulekha is an online website that offers a variety of services designed to connect people from around the world. The information, whether personal information of any form of self-expression is used to help you describe yourself to other users. Sulekha also collects additional information in order to operate and improve our service. Sulekha US LLC, is the sole owner of the information collected on the Sulekha site.

PROFILE SHARING CUSTOMIZATION:Whether you register on Sulekha, what parts of your profile you fill, who you add to your network and what visibility levels you want to set for your profile are entirely up to you in the form of settings you can make on your profile. You also have the ability to change these at any point in time. Sulekha will show the information to enable personal networking only based on your preference.

VISIBILITY OF NETWORK LINKAGES: Where applicable, the path of members that connect you with another member of your network will be displayed to that member. This network path will not be shown to those who are not members of your personal network.

VISIBILITY OF PUBLIC CREATIVE CONTRIBUTIONS: In addition to being a social and professional networking site, Sulekha also provides a variety of forums for its members to express themselves in the form of articles, columns, opinions, comments, reviews, art and photographs. Since this expression is linked to the member's identity and the expression is in the public domain, the compilation of a member's creative contributions to Sulekha will be visible to all visitors of Sulekha whether or not they are registered members of Sulekha.

VISIBILITY OF PRIVATE MESSAGES WITHIN NETWORK: You will be able to create and share messages within your personal network. The visibility of these private notes will be restricted to your network unless you or one of the members in your network choose to forward it to others within or outside Sulekha.

SHARING OF INFORMATION WITH THIRD PARTIES: Sulekha takes your privacy very seriously. Sulekha will never sell, rent, or otherwise provide your personally identifiable information to any third parties unless it is to carry out your instructions and to provide specific services. As an example, we send your information to a credit card processing company to process a payment you have made for the use of a Sulekha service. These third parties are bound by strict confidentiality agreements which limit their use of such information. In addition, Sulekha may share your information to send direct mailers or complimentary coupons/offers to a mailing agency to process postal mailing. Please note that these email communications may contain commercial messages of advertisers; however, Sulekha does not provide your personal information or emails to any of the advertisers; we just include the advertising banners they provide us in the emails that we send. As always you can opt out of the newsletters or promotional announcements.

PARTNERING WITH OTHERS: Sulekha may partner with other online services to offer a combined service. Whenever we offer such combined services, Sulekha will make it clear who the partner is and it will be entirely up to you to use or not to use the service. Where any personal information is passed along to the partner you will be informed prior to that sharing.

PROVISION OF AGGREGATE DEMOGRAPHIC INFORMATION TO THIRD PARTIES: Sulekha reserves the right to provide aggregate demographic information of its member base to advertisers and others so as to attract pertinent advertisers to advertise on Sulekha. We do not shared personal information of individual users with advertisers.

COMMUNICATIONS TO OTHERS FROM YOU THROUGH SULEKHA: You will be able to send emails to others -- members and non-members -- through the Sulekha system.
